Whistleblowers and the Law

Under California law, whistle blowing is simply exposing your company's wrongdoing in some fashion. It can involve bringing to light either you or someone else being victimized. After you do so, you are a protected employee and can not be punished for your honesty.

Within employment law, whistle blowing is a subset of wrongful discharge, but does not need to involve someone being fired. It can also involve demotions, being assigned menial tasks, or any other form of retaliation.

You can qualify as a whistleblower by going to an outside agency such as OSHA and complaining that an employer has engaged in illegal activity, safety violations, discrimination, or other offenses. Or you could complain within the supervisory chain in your own company or go to your human resources department.
