There are two types of sexual harassment that make for valid employment law cases:

  • Quid pro quo, in which an employer or supervisor demands sexual favors in exchange for promotion or other job benefits. Voluntary sexual contact also qualifies as quid pro quo harassment, provided that it is with a superior. The law considers sexual contact with a superior to be inherently coercive.
  • Hostile work environment, which means that there is a constant atmosphere of unwelcome sexual suggestions, lewd language and imagery, etc. People who suffer a hostile work environment often fear going to their jobs. A single flirtation or suggestive comment may not qualify as sexual harassment, but may be against company policy.
